I believe there is a certain word that is banned for being racist. Should this song be unbanned then that word should also start seeing some freedom of expression and at this point I think it will take over if allowed. Ofcoarse unbanning the song and saying its part of a culture will reclassify it as a religion of violence, which is against the law in any case.

There is another long shot method to be used. As I have said before if the song is sung and you find that an actual boer by the definition of a farmer is indeed shot you could rule him as a terrorist leader giving orders to murder our citizans.

I agree there star, if people say saying that song is freedom of speech then we should be able to use a certain word(you know the one)...........

Yes you might be taking some of juju's freedom of speech away but the fact is that his song is racist and discrimination is unconstitutional

its not whether the song is racist, its the context he's used and popularised it in...

in the sane way, the K word actually means native or African...but it's become a racist word because of the context...

He's welcome to march on the con court but they have no legal jurisdiction on the matter...

It has never changed, nor can the context be construed to that of a meaning which refers to a black native person, it's meaning has always been non believer, the term it self does not refer to a black person or that of but rather the lack of faith, because large part of Africa had not even heard of Christianity they where called by that name.Because Africa has dark skin inhabitants, it attached it self to that ethic group. It's however a term not bound but racial or ethic group. Our law states a derogatory term for any person, which loosely translates to any and all South Africans.

He is suspended for two years, but that suspension was then suspended for three years.
What a farce.

They way I have it, is that if he commits the same thing that got him found guilty, the two year suspension from the ANC is then implemented.

For now he remains where he was a week ago.
There are two types of suspended sentences. A judge may unconditionally discharge the defendant of all obligations and restraints. An unconditionally suspended sentence ends the court system's involvement in the matter, and the defendant has no penalty to pay. However, the defendant's criminal conviction will remain part of the public record. A judge may also issue a conditionally suspended sentence. This type of sentence withholds execution of the penalty as long as the defendant exhibits good behavior. For example, if a person was convicted of shoplifting for the first time, the judge could impose thirty days of incarceration as a penalty and then suspend the imprisonment on the condition that the defendant not commit any crimes during the next year. Once the year passes without incident, the penalty is discharged. If, however, the defendant does commit another crime, the judge is entitled to revoke the suspension and have the defendant serve the thirty days in jail.

I heard it was 2 years. And I can say this does not set me at ease. Infact it is causing more concern. If Malema goes and makes his own party it might be a good thing. But if he is only for 2 years then the elections are only a few months away after his re-introduction. In that time he can run for presidency and that is whats worrying me.

Low profile for 2 years. Then all hell can break loose in a few months with no barriers.
