Warner Bros Interactive, which owns developers NetherRealm and Rocksteady, recently signed a deal with Epic Games which has licensed the Unreal Engine 3 for the company until 2014. Both NetherRealm and Rocksteady will only be using Unreal Engine 3 for all projects that the two developers undertake in this time frame

Hopefully this means that they will be working on Unreal engine 4 and that even though they signed to license the UE3 that other companies can still use the engine. Either way if they are stuck on the UE3 engine it isnt a bad thing. That engine has proven beyond anything that it is capable for the highest standards of games ever.
