Has anyone evertried to return a game because they didn't agree to the EULA?

I doubt it. I doubt anyone on the forum or 99.99% of gamers ever read the EULA on the games they play.

Prometheus you sound like a cynic to me. Steam is here to stay whether you like it or not. As for the rights it is legal even if it is not completely fair. If you install the game and thus inherently agree to the EULA you make it legal if you realize it or not. Because you are, under your free will, empowering the contract stipulated in an EULA you are legally bound by it. Remember that the agreement in a contract overrules anything the law may state about the sale. So if you accepted the EULA upon installation of the game then you are not allowed a transfer of ownership, if you did not accept you may do the transfer.

Lets take an example: jee goes and buys Elder Scrolls IV: Oblivion for Tribble as a present. Before jee actually gives the copy to Tribble she is interested to actually se what the game is like so she installs it on her pc and thus agrees to the EULA upon installation thereof. So then jee checks it out and later that week gift wraps it and sends it to Tribble.

Now that is one of the issues right there. The fact that jee first installed and accepted the EULA empowers the EULA as a valid contract. Thus jee is not actually within the law when she gives the game as a gift and thus transfer the ownership. In the US there are cases which is made based on an act named "first sales" which states that you are allowed to sell something if you bought it which protects consumers. In every one of the successful cases it was not possible for the software company to prove that the user accepted the EULA due to some issues. In the ones where the software companies won it was a case of you pressed a button that says I accept so the EULA is in effect and thus you have broken the law and stripped us of revenue.
