However, the USPTO's idea of validity doesn't fly in all countries. A Dutch judge ruling on Apple's use of U.S. Patent 7,657,849 (the original unlocking patent) to try to ban sales of Samsung smartphones ruled the Apple patent was "obvious" (in Dutch he said it was "lying close at hand" -- literally "for the hand lying") and likely invalid. He points out that Neonode Inc.'s (NEON) N1m -- launched in 2005 -- had a virtually identical unlocking feature, albeit with a different graphic.

He also acknowledged a similar on-off use in Guitar Rig:

...as pointed out by Samsung's attorney's. The guitar after-effects software was available back in 2004 -- three years before the first iPhone was released. The judge complained that the Apple work was "not inventive" and suggested that the patent should be invalidated.

Samsung has removed one other minor GUI animation from its smartphones in the Netherlands, escaping a potential sales ban. However, the threat of a ban in the U.S. where questionable patents hold greater power, still looms.
Damn those "innovative" Apple people... Apple the Patent Troll to rule them all...

Did you come right? What error code do you get? I know some peeps who also had trouble updating, there are some work arounds...

Nah dude, on the 3rd run before lunch, the update was still running fine, until after lunch it failed again, I'm so gatvol already, i was on the apple forum quickly, i see some okes say you have to disable your anti-virus, it seems to let the update fail as well if it's on :|

the more i look at this the more i think that i'm just going to leave my iPod touch as is....

Its not that bad.

I got my iPad just before iOS 5 was released and I did my update with no experience with iAnything and mine went without a hitch. :D

So i'm finally running on iOS5, and what a mission it was to get it :|


Word of advise, when wanting to update, disable any firewall, including windows own firewall as well, that seemed to be the major prob for me

One owner has told the Guardian that Apple contacted him directly and asked him to install a monitoring program on the phone to try to diagnose the problem, which is so far unexplained.

In its data sheet for the iPhone 4S, which was released earlier this month, Apple quietly noted that the standby time for the new phone would only be 200 hours - compared to 300 for the iPhone 4, and 250 hours even for the original 2007 iPhone. The company did not offer any reason when asked why by the Guardian, but noted that other lifespans such as 3G talktime were as long or longer than previous models.

This is worrying for South African owners. It's great living in the US, Canada, England, etc. where Apple will make the effort to solve your problems. SA users experiencing this are in for a good deal of frustration. :?

Even people at my office with iPhone 4's are experiencing terrible battery drain on iOS 5. Turning off location services and other things that shouldn't have to be turned off seems to help... :-P

So last week global sales of the Samsung Galaxy S II passed the 10 million mark.
Samsung are hoping to hit the 15 million mark before the new year...

This on top of news released earlier this week that Samsungs total sale for last quarter was greater than Apples... much greater.

Ja, I've seen it myself. Definitely draining quicker than before, though not exactly "drastically" so. Although if I leave Tom Tom open in the background . . .

Don't use my ipad as much as I thought but I like the reminders thats been added. Not sure what the hype behind ios5 is although my sister says its a big deal.

Updating my ipad was terrible. It wants to sync stuff to pc although I dont know what. The other thing that I was afraid of was that it said it was going to wipe my ipad and I have too much valuable data on it for that to happen. Atleast backup is ok.
