Claiming damages from other insurance co

Hi Folks
Some complete retard in a Seat crashed into the side of my car by cutting in too quickly trying to overtake me this morning. The reason he was trying to overtake (in the face of oncoming traffic nogal) was because he was cheesed off I had let a car into the steam of traffic.

Anyway, long story short, the damage is less than my rather astronomical excess of R6500. My insurance says to claim directly from his insurance. Trouble Is I don't know his insurance and don't know how forthcoming he will be with this info.

Anyone know how I go about instituting a claim directly from his insurance if I can find out what insurance company and what documentation etc I would need?

Have you got his personal details, name, ID no, telephone, registration?
Surely if you give them to your insurer they will be able to tell you what his insurance company is?

Send him a lawyer's letter if he doesn't want to comply.

Yup, got all his details, but for some reason, my insurer seems vague of his insurer :?
Anyhow, Will try them again tomorrow. Something tells me I'm in for a long hard haul...

Seems I'm gonna have to go the small claims court route. Anyone got any valuable experience therein?

perhaps he doesnt have insurance.

you could just call him and tell him to do the repairs your insurance company just needs all his info including his insurance company just to complete the paperwork?
when in doubt, paddle out... ;)

You won't be able to claim the full amount in small claims court.

Best you contact him and request full payment or you will take him to court.

Did this happen on Rabie by chance?

He's got insurance, they're just very loath to do anything...they say max payout would be 70% of the smallest quote they receive, and that's only is THEY decide I was not in the wrong...

Well small claims court is up to R7000 now. Don't know when it moved up form R3000.
No not Rabie - close to Linden police station, Main st, just off boundary.

Good to hear small claims is up to R7000. Go that route then.

He was clearly in the wrong.

It depends how he reported it to the police. If he acknowledges the accident as his fault then it's 'common cause' and his insurance company are obligated to pay out. If they give you any hassles, call the insurance ombudsman. Impartial mediator that doesn't cost you a cent and with the power to force the insurance to pay.

Or you could always get a group of friends to paintbomb his car late at night if the settlement isn't towards your liking. Just make sure you have an alibi. :twisted:
